DOMA (Defense of Marriage Act)

Introduction
The so called "Defense of Marriage Act" seeks to change the
definition of marriage in Massachusetts as being only between one man
and one woman. DOMA was sponsored by an organization called Citizens
for the Defense of Marriage, and is heavily supported by
ultra-conservative groups throughout the country. Conservative groups
have been working for several years on legislative efforts to impose
their definition on marriage, families, and eligibility for
family-related benefits. Since the decision of the Massachusetts
Supreme Judicial Court, efforts have expanded, and representatives of
ultra-conservative groups from around the country have been extending
their efforts into Massachusetts. These groups have proposed a
constitutional amendment that would overturn the recent SJC decision
ruling that same sex marriage may not be prohibited under the
Massachusetts Constitution. House 3190 begins an amendment process
that needs approval in two successive legislative session and, if
approved, then goes onto a state-wide election ballot. Civil rights
groups working to uphold the SJC decision -- such as the broad
coalition "Massachusetts Equality" -- are working to prevent an
affirmative vote of the legislature meeting in Constitutional
Convention. The so-called "Defense of Marriage" amendment:
- would prevent almost any legal recognition of same-sex couples
- does not protect any marriage or any family
- attacks the principles of equality enshrined in our existing
constitution
- threatens peace of mind and the economic security of families
formed by same-sex couples
Families formed by same-sex couples have the same needs and should
have the same rights, protections, and responsibilities as families
formed by opposite-sex couples. JALSA supports the right of same-sex
couples to "civil marriage" and to the rights and responsibilities
that accompany civil marriage under the law. JALSA opposes efforts to
enact DOMA - and its definition of marriage.
